Terms of Service

These terms govern your access to and use of FastTender. By creating an account or using the service, you agree to them.

Who we are

FastTender is an Australian Government tender intelligence platform operated by FastTender ("FastTender", "we", "us"). We help businesses find, qualify, and respond to Australian Government approaches to market.

What FastTender does

FastTender aggregates and analyses tenders from official Australian Government sources, principally AusTender, and provides AI assisted tools to help you evaluate and respond to them.

Tender and reference data is republished from those sources for your information. We take care with it but we are not the publisher of it, and it can be incomplete, delayed or superseded. The notice on AusTender and its request documentation are the authoritative version, and you must verify details there before acting, particularly closing times and conditions for participation.

Your account

You must provide accurate information when creating an account and keep it up to date. You're responsible for all activity under your account and for keeping your credentials secure.

You must be at least 18 and authorised to act on behalf of any organisation you register. One person may not share a single seat with others. Team access is provided through additional seats on paid plans.

Plans, billing and payment

FastTender offers a free plan and paid subscription plans. Paid plans are billed in advance on a recurring basis, monthly or yearly, at the price shown at checkout in Australian dollars (AUD).

Our order process and payments are conducted by our reseller, Paddle.com Market Limited ("Paddle"). Paddle is the merchant of record for all orders - it is the authorized reseller of FastTender subscriptions. This means Paddle, not FastTender, is the seller of record for your purchase.

"Paddle" (or "Paddle.net") will appear on your card or bank statement for FastTender charges. Paddle collects payment, issues tax invoices and receipts, and is responsible for charging and remitting any applicable tax including GST. Tax, where it applies, is calculated and added at checkout.

Paddle also provides buyer support for billing and payment questions. You can manage your purchase, view invoices, and contact Paddle's buyer support at paddle.net. For questions about the service itself, contact us at billing@fasttender.com.au.

Your subscription renews automatically at the end of each billing period at the then-current price until you cancel. We'll tell you in advance of any material price change.

Cancellations and refunds

You can cancel your subscription at any time from your account. When you cancel, your plan stays active until the end of the current paid period, and it won't renew after that. You keep access to paid features through the end of the period you've already paid for.

We do not refund a billing period because you changed your mind or did not use the service during it, since you can start on a free plan and cancel at any time before renewal. This does not affect your rights under the Australian Consumer Law, which cannot be excluded: see our Refund Policy.

Acceptable use

You agree not to misuse the service, including scraping or bulk extracting data, reverse engineering, reselling access, interfering with operation or security, or using FastTender to breach any law or third party right.

You're responsible for the content you submit (such as proposals and company information) and for ensuring you have the rights to use it.

Intellectual property

FastTender, including its software, design, and compiled data sets, is owned by us and protected by law. We grant you a limited, non-exclusive, non-transferable right to use the service while your account is in good standing.

You retain ownership of the content you submit. You grant us the rights needed to host, process, and display that content in order to operate the service for you.

AI features and outcomes

FastTender uses AI to score opportunities, draft content, and surface insights. AI output can be incomplete or wrong. It is decision support, not professional, legal, or contracting advice, and you are responsible for reviewing and verifying anything you rely on.

FastTender does not guarantee any contract award, shortlisting, or business outcome. Nothing in the service is a promise of results.

Availability and support

We work to keep FastTender available and reliable, but we don't guarantee uninterrupted access. We may perform maintenance, update features, or modify the service over time.

Support for the platform is provided by email. Billing and payment support is provided by Paddle at paddle.net.

Liability

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies those guarantees or any other right you have under a law that cannot be excluded.

Where we are permitted to do so, our liability for a failure to comply with a consumer guarantee is limited to resupplying the service or paying the cost of having it resupplied.

Subject to the two paragraphs above, and to the maximum extent permitted by law, the service is provided as is and as available, and FastTender is not liable for indirect, incidental, special or consequential loss, or for lost profits or lost business, arising from your use of the service. Again subject to those paragraphs, our total liability for any claim is limited to the amount you paid us in the twelve months before the claim.

Changes to these terms

We may update these terms from time to time. If we make material changes, we'll take reasonable steps to notify you. Continued use after changes take effect means you accept the updated terms.

Governing law

These terms are governed by the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of New South Wales and the courts competent to hear appeals from them, for any dispute that is not resolved informally.
